Terms & Conditions of the Supply order is described below: -

 

  • SCOPE OF WORK

            Supplier have to supply the ordered item to District Drugs Ware Houses located at different districts of the state of Assam as per the Annexure-2 enclosed with the supply order.

  • DELIVERY PERIOD : Total ordered quantity to be supplied within best possible time, maximum by 45 days from placing of P.O. A declaration in non-judicial stamp paper to be submitted in this regard along with the technical bid without which the tender will be rejected.
  • TEST REPORT: The successful Bidder must submit Batch Wise Test Analysis Report (in original) from NABL/NIB/CDL or equivalent authorized Lab from Govt. of India for performing quality testing for every batch of items before commencement of supply to Tender Inviting Authority/Procuring Agency or along with the bill raised, without which no payment will be made.
  • SHELF LIFE : Product should have Expiry of minimum 2 years. The labeled shelf life of items supplied should be not less than the period mentioned against each item in list of Items. The remaining shelf life of the items at the time of delivery should not be less than ¾ of the labeled shelf life. Only those bidders shall quote who can manufacture and supply the product with the required shelf life. The product of labeled shelf life lesser than required shelf life will not be accepted. 
  • SECURITY DEPOSIT : The successful bidder shall submit Security Deposit of 5 % of the order value in the form of Bank Guarantee/ Demand Draft/Fixed Deposit from any Indian Schedule Bank in favour of “State Health Society, Assam” within 10 working days from date of issuing of Purchase Order by Tender Inviting Authority. Such Security Deposit shall be valid for a period of 12 months from the date submission of the Security Deposit.
  • Agreement: The successful Bidder shall execute an agreement on non-judicial stamp paper of value Rs 100/- (stamp duty to be paid by the Bidder) within 10 working days from the date of issuing of Supply order.
  • PENALTY FOR DELAY IN SUPPLY :- If a supplier fails to execute successive order within the stipulated time frame, in full. In case there is delay in delivery beyond the stipulated period as mentioned in the purchase order, there shall be penal deduction @ 1% of the value of delayed goods per week of delay or part thereof subject to a maximum of 5% of the total order value. Once the maximum price reduction is reached, termination of the contract may be considered. Non-performance shall make the successful bidder liable to be disqualified to participate in any tender for the next 3 years for that product, in addition to forfeiture of Security Deposit and other penal actions.
  • ROAD PERMIT : Arrangement of Road Permits for dispatch of consignments shall be the responsibility of the supplier only.
  • Product debarment: In case three batches of a particular item supplied by a Firm failed the quality test, the Firm shall be debarred from participation in any tender floated by the TIA for three years from the date for that particular product. In case of non-supply or incomplete supply (i.e less than 90% of the total ordered quantity) by the approved bidder within agreed delivery period including the delay penalty period or any such extended delivery period then the concerned rate contract shall be cancelled and the bidder shall be debarred for participating in any bid called by the Authority for three years from the date of debarment for that particular product.In case the manufacturer/importer (Firm) supply 90% or more of the ordered quantity but fails to supply the entire quantity within the allowed delivery period then the firm shall be levied a penalty @ 10% of the value of the short supplied item and same shall be adjusted against the payment for supply. In addition to product debarment the performance security deposited by the supplier for that particular product shall be forfeited and apportioned towards financial penalty.In case more than one but less than three batches of a particular item supplied by a Firm failed the quality test, than the total financial value will be deducted from the payment of the firm, either used/not used at peripheral level. The failed batch to be picked up from the Central/State Drug Ware House at firm’s own expense.
  • PAYMENT PROVISIONS :Payment will be made after completion of 100% supply and within best possible time against submission of bill & receipted challan (in triplicate) with stock book entry detailsfrom the receiving authority& should be accompanied with the copy batch-analytical test reports from NABL Lab the desired payment against the supply from the NHM-Authority.

          All other Terms & Conditions as specified in the TENDER NO:  NHM-38012/3/2019-NVBDCP-NHM/P-116, Date: 17.06.2020  shall be applicable.
