With reference to above, we are pleased to place this order for supply of  Tablet Paracetamol 500 mg as per “DETAILS OF ITEMS & PRICES” and “TERMS & CONDITIONS” stated herein below:

Terms & Conditions of the Supply order is described below: -

 

  • SCOPE OF WORK

           Supplier have to supply the ordered drugs to District Drug Ware houses located at different districts of the state of Assam as per the Annexure-2 enclosed with the supply order .

  • DELIVERY PERIOD : Supply shall commence within best possible time from the date of placement of order and supply of full quantity should be completed within 30 days from the date of issuing the supply order. Supply  should preferabley in generic name but in view of emergency requirment of Tablet Paracetamol 500 mg in the field, brand name will also be accepted but the MRP should be stroked out from the pack to be supplied . Supplier also needs to communicate officially to the designated Officials of the District/Regional/Central/Medical College ware houses before 5 days prior to commencement of delivery of ordered drugs.

 

  • TEST REPORT: The supply should be accompanied with either in house batch wise test analysis report or the batch-analytical test reports from NABL Lab before the commencement of supply to obtain the Dispatch Clearance Certificate from the NHM-Authority but to get the payment against supply the batch wise test analysis report from NABL Lab must be submitted along with bills and receipt-challan copies.

 

  • SHELF LIFE : The supplied Drugs (covered under Drugs and Cosmetics Act 1940) should have shelf life period as prescribed in the Drugs and Cosmetics Act 1940 and rules there under. There should have shelf–life of minimum 1 year from the date of supply.

 

  • SECURITY DEPOSIT : The successful Bidder shall execute an agreement on non-judicial stamp paper of value Rs 100/- (stamp duty to be paid by the Bidder) within 5 working days from the date of issuing of Supply order. The successful bidder shall submit Security Deposit of 5 % of the order value in the form of Bank Guarantee from any Indian Schedule Bank in favour of “State Health Society, Assam” within 10 working days from date of issuing of Purchase Order by Tender Inviting Authority. Such Bank Guarantee shall be valid for a period of 1 year from the date of Purchase Order. If the supplier fails to execute the order or fails to perform the services as per agreement, actions, the Bank Guarantee shall be enchased and the amount will be forfeited.

 

  • If a supplier fails to execute successive order within the stipulated time frame, in full, that firm will be liable to debarred for the particular product, for a period of 1 year.

 

  • ROAD PERMIT : Arrangement of Road Permits for dispatch of consignments shall be the responsibility of the supplier only.

 

  • PAYMENT PROVISIONS : Payment will be made within 30 days from receipt and acceptance of materials at destination against submission of bill & receipted challan (in triplicate) with stock entry details, and test certificate of batches supplied. In case there is delay in delivery beyond the stipulated period as mentioned in the purchase order, there shall be penal deduction @ 0.5% of the value of delayed goods per day of delay or part thereof subject to a maximum of 10% of the total order value. Once the maximum price reduction is reached, termination of the contract may be considered. Non-performance of the contract provisions shall make the successful bidder will be liable to disqualification for the particular product, for a period of 1 year from NHM Assam tender, in addition to forfeiture of Security Deposit.

 

  • Others : Rates of Drugs, Surgicals, Sutures etc. should not be more than rates approved by GOI(NPPA). If rates are more than NPPA approved rates, then excess amount will be recovered from the manufacturer.

        All other Terms & Conditions as specified in the TENDER NO: NHM-18011/29/2018-PROC-NHM/29-P,Date:-28.12.2018 shall be applicable.
